Kapstadt Autovermietung - Allgemeine Geschäftsbedingungen - Südafrika Mietwagen

Rental Conditions   "Yourcar" hereby rents to their renter referred to on page 1 (hereafter referred to as "The Renter") the motor vehicle described on page 1 subject to all terms and conditions detailed on page 1 hereof and subject to the following conditions:

1.At the place and on the date specified on page 1 the renter shall return the vehicle together with all its accessories in the same condition as when received, fair ware and tear expected. 
2. The renter shall pay yourcar on demand all charges due under this agreement at the tariff in force at the time this contract is entered into and acknowledges liability for all fuel consumed during rental. 
 
3. The vehicle shall not be used or driven: 
  • A. In contravention of any law
  • B. For the convenience of any persons or property for hire.
  • C. In any speed test, race or contest.
  • D. By any person under 23 yr. of age or who has not possessed a valid unendorsed license for a minimum of 2 yr.
  • E. By any person who has given Yourcar false information.
  • F. Behind the borders of the Republic of South Africa. Permission is required before vehicle may leave South Africa 

4. Yourcar shall not be responsible for the loss or damage to any property left or transported in or upon the vehicle. Accident and Theft insurance is compulsory for all rentals.  

5. Yourcar has insured the vehicle and the renter shall be entitled to the benefits of said insurance against Accident and Theft. 

Please Note:
In the event of an accident occurring when the vehicle was not driven by the renter, or other authorized driver as nominated on the rental agreement, the renter will be reponsible for the full damage to or loss of the vehicle. The renter will also be responsible if the vehicle was driven on unsuitable roads, if the renter was driving negligently or if no other car, animal or object was involved. 

Terms and conditions: Contract Fee R95.00 

6. The renter is at all times responsible for the first amount of any claim up to the excess referred to in the current rate brochure. A double excess is applicable on gravel/dirt roads.  

7. The renter shall be solely liable for all fines or penalties imposed for parking or traffic offences whilst the vehicle is held or used pursuant to the agreement. 

8. Distances are calculated from depot to depot.  

9. Rates and conditions are subject to change without notice.  

10. Breach of any terms and conditions negates the insurance cover.  

11. Yourcar shall not be liable for any damage arising out of any defect in or mechanical failure of the vehicle, nor for any loss of /or damage to any property transported or left in the vehicle, nor for any indirect damages, consequential loss, loss of profits or special damage of any kind for any breach of disagreement. The renter indemnifies and holds Yourcar harmless against any claims, which may be brought against Yourcar by any person or entity resulting from the use or position of the vehicle by the renter.  

12. In case of an accident/theft contact Yourcar immediately. A full report must be made to the nearest Police Station with in 24 hours where the accident occurred and 6 hours in case of theft. The case number must be obtained. In an event of the accident/theft not having been reported within the specified times, the renter will be liable for the full damage/loss of the vehicle.  

13. No Cover on Tyres/Rims, water and under carriage damage to the vehicle.  

Terms and Conditions
RATES
All rates are inclusive of maintenance and oil and are inclusive of VAT. The lowest applicable rate combination will be charged in each case. There will be an additional fee of R10 per day if a second driver has been nominated. All rentals are subject to a once-off contract fee of R95.00.  

FUEL
All our vehicles leave with a full tank and the Renter pays for refuelling on return.  

DRIVERS LICENCE
The Renter and any authorised drivers must be in possession of a valid, unendorsed driver's licence which has been in force for a minimum age of the Renter or authorised driver is 23 years.  

EXTENDED HIRE PERIODS
Extension beyond the originally agreed date of termination must be arranged immediately. 

INSURANCE
Acceptance of cover is compulsory on all rentals and the client must choose which option is required at the time of rental. A double excess is applicable if an accident occurs on gravel roads or if any of the Terms and Conditions of the Standard Rental Agreement are breached. In case of an accident/theft contact

YOURCAR - CAR HIRE immediately.
A full report must be made to the nearest police station within 24 hours where the accident occurred and within 6 hours if a theft has occurred. A case number has to be obtained from the police. There is no cover for tyre, rims, windscreen, water or under carriage damage to vehicles. 

PAYMENT We honour Visa, Mastercard, Diners Club and American Express cards.  

BORDER
No vehicle may be taken across South African Borders without permission. 

CONDITIONS OF RENTAL
All vehicles are rented subject to the terms and conditions of our standard Rental Agreement.Rates and conditions of rental are subject to change without notice.All vehicles are constantly serviced and controlled by a qualified GERMAN MASTER MECHANIC
